TOEFL (Test of English as a Foreign Language) tests the English language skills of non-native students who want to study or work in countries where English is the language of communication. It is an exam developed by ETS (Educational Testing Service). More than 6,000 institutions and agencies in 110 countries rely on TOEFL scores to select students with the English skills needed to succeed.

 
TOEFL tests all four language skills that are important for effective communication: speaking, listening, reading and writing. There are three versions of the TOEFL: paper-based, computer-based (CBT) and internet-based (iBT). The majority of test centers now use the Internet Based TOEFL (iBT).
 
Paper-Based & Computer-Based TOEFL The computer-based TOEFL (CBT) was introduced in 1998. Its format is very similar to that of the original paper-based test. In areas where the computer-based test is not available, the paper-based test is used. Remember that you cannot change your answers in the first two sections of the CBT after you have confirmed them on the computer. There are more “types” of questions in the CBT, such as clicking on a phrase and looking at a diagram. Before you start the CBT you will take a tutorial which shows you how to answer the questions properly. The total time you will spend taking the paper-based test is 2.5 hours. The International English Language Testing System (IELTS) is a test of English language proficiency, developed by the University of Cambridge Local Examinations Syndicate. Today IELTS is accepted as evidence of a prospective student’s level of English by most universities in English speaking countries.

 
There are two different IELTS tests that you can do: Academic and General. But this test is usually taken for university admissions. IELTS is not just a test that you can pass or fail. Your English proficiency skills are reported according to a scale from bands one to nine.
 
Tests and tasks conducted have been designed keeping in view the general interests of the educated people, so the person taking the test needs not to do any specialist courses. The test contains four parts – Reading, Writing, Listening, and Speaking.
 
The reading component of the IELTS test The IELTS reading test duration is one hour. During this time the candidate has to read three texts of between 500 and 900 words each. The texts and questions increase in difficulty. He has to answer 40 questions within the time limit of 60 minutes. Most students find it difficult to complete the whole paper, so it is important for candidates to be completely prepared for all the tests. (more…)

Naturalization is the act whereby an individual voluntarily and actively acquires citizenship, which is not his or her citizenship at birth. Naturalization is mostly common among migrants who have immigrated to a country and have willingly chosen to become a citizen of that country after meeting specific requirements.

 
The basic requirements for naturalization are full-time residency for a minimum period as required by the law, and a pledge to uphold that country’s laws. In the United States, the Congress has the authority to prescribe a uniform rule of naturalization that is overseen by state courts. State court refers to any court of law having common-law jurisdiction and a clerk and seal.
 
Until 1952, the Naturalization Acts allowed only white persons to become naturalized as citizens of the United States. The initial parameters on naturalization were however set by the Naturalization Act of 1795 as ‘free, white persons’ who have been resident for five years or more. The period of five years was extended to fourteen years in the Naturalization Act of 1798, a part of the Alien and Sedition Acts. However, this was canceled in 1802. (more…)

U.S. employers wishing to sponsor a foreign national for permanent residency face the daunting task of navigating through the treacherous waters of U.S. immigration laws. This article seeks to provide employers with a basic outline of the process.
 
EMPLOYMENT BASED IMMIGRATION
 
A U.S. employer may sponsor a foreign national who is abroad or currently in the U.S. under their employ for permanent residency (colloquially known as a “greencard.”) through an employment based immigrant petition.

 
There are 5 categories or preferences within the Employment Based (EB) system, e.g. EB-1, 2, 3, 4, and 5. The vast majority of applicants will likely fall into the EB-2 or EB-3 category. EB-1 petitions involve foreign nationals of extraordinary ability, multi-national executives and managers, and outstanding researchers or professors. EB- 4 and 5 pertain to certain special immigrants and investors respectively.
 
Generally, EB-2 and EB-3 Petitions require a labor certification from the Department of Labor and a job offer. Workers hoping for permanent residency on the basis of an EB-2 or EB-3 petition must generally undergo a three step process.
 
STEP 1 - THE LABOR CERTIFICATION
 
A Labor Certification is a determination made by the Department of Labor that there are no U.S. workers who are qualified and available for a position in which a U.S. employer seeks a foreign worker. To receive such a determination, an employer must show valid recruitment for a prescribed period of time and demonstrate that there are still no qualified and available U.S. workers to fill that position. The Department of Labor then issues a ruling on the application. The application for labor certification is called PERM (Program Electronic Review Management). (more…)
