Question: ‘Hi. Not sure where to turn. I have an appointment with an immigration officer but wanted to speak to you first so I know whether my visit will be a waste of time. My wife committed adultery and had a child with another man during our 4 year marriage. I only became aware of this now that the child was not mine. I brought my wife on a fiance visa in January 2003 and we married in April 2003. She received her 10 year green card with conditions removed in July 2006. The adultery was committed in November 2004 and the child was born in Augest 2005. Again, I had no knowledge of this until very recently when my wife admitted the act and the paternity test proved I was not the father.

Is there anything I can do about this–about having her deported, etc. I understand that she does not have conditions but the adultery and child conceived took place without my knowledge at the time we applied to have her conditions removed. Thanks for your time.’

Answer:

‘I would write a letter and go to the nearest immigration office and ask what unit would be most interested in this problem. In New York, it would go to the marriage fraud unit. However, reporting the act does not mean the Department of Homeland Security will act on the fraud. Make sure that you include her name, date of birth, place of birth, and alien number on the letter.’
